These Terms and Conditions (T&C) govern the use of services offered by AGBklar.de.

§ 3 Contract Conclusion

Registration

The contract is concluded through registration on our website.

  • Complete and truthful provision of required data
  • Confirmation of T&C and privacy policy
  • Email address verification
  • Minimum age of 18 years

Contract Completion

The contract is completed through the following steps:

  1. Filling out the registration form
  2. Email address confirmation
  3. Payment of the agreed fee (for paid plans)
  4. User account activation

§ 4 Prices and Payment Terms

Pricing Structure

Current prices can be found on our pricing page. pricing page.

  • All prices include statutory VAT
  • Price changes are announced at least 30 days in advance
  • Existing contracts remain at the agreed price

Payment Terms

  • Payment is made in advance for the selected billing period
  • Accepted payment methods: Credit card, PayPal, SEPA direct debit
  • In case of payment delay, we reserve the right to block the service
  • Refunds are only made in exceptional cases at our discretion

§ 5 Usage Rights and Obligations

Usage Rights

  • Use of services for own business or private purposes
  • Download and storage of generated analyses
  • Use of results for internal decision-making processes
  • Sharing analyses with third parties (e.g., lawyers) for consultation

Usage Prohibitions

  • Commercial redistribution of analyses without permission
  • Upload of illegal or unlawful content
  • Misuse of AI systems or technical infrastructure
  • Attempts to compromise platform security
  • Use for anti-competitive purposes

§ 6 Liability and Warranty

No Legal Advice

The analyses and summaries provided by AGBklar do not constitute legal advice and do not replace consultation with a qualified lawyer.

The user bears full responsibility for the interpretation and application of analysis results.

Liability Limitation

AGBklar is only liable for damages based on intent or gross negligence.

  • Liability for slight negligence only in case of violation of essential contractual obligations
  • Liability amount limited to the contract-typical, foreseeable damage
  • No liability for indirect damages, lost profits or consequential damages
  • Liability for data loss only in case of intent or gross negligence

§ 7 Termination

User's Right to Terminate

  • Termination at any time with 30 days' notice to the end of the month
  • Termination via user account or by email
  • No refund in case of termination before the end of the term
  • Access to services ends with the expiration of the notice period

AGBklar's Right to Terminate

  • Immediate termination in case of violation of these T&C
  • Termination in case of payment delay after unsuccessful reminder
  • Termination with 30 days' notice without stating reasons
  • Termination in case of service discontinuation

§ 8 Final Provisions

Applicable Law

German law applies excluding the UN Convention on Contracts for the International Sale of Goods. Jurisdiction is Duisburg, provided the user is a merchant, legal entity under public law or public law special fund.

Changes to T&C

AGBklar reserves the right to change these T&C at any time. Material changes will be communicated to the user at least 30 days before they take effect.

If the user does not object within 30 days, the changes are deemed approved.

Severability Clause

Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision will be replaced by a valid provision that comes closest to the economic purpose.
